1. Acceptance of Terms

By accessing or using the Baba! mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the App.

These Terms constitute a legally binding agreement between you and Baba! ("we," "us," or "our"). If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Baba! is a free mobile application that helps users discover and share information about halal restaurants and dining establishments. The App provides:

- Restaurant discovery and mapping services

- User-generated content including reviews, ratings, and restaurant submissions

- Location-based restaurant recommendations

- Community features including favorites and user profiles

The App is provided free of charge. We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice.

3. User Accounts and Registration

3.1 Account Creation

To use certain features of the App, you must create an account. You agree to:

- Provide accurate, current, and complete information during registration

- Maintain and promptly update your account information

- Maintain the security of your password and account

- Accept responsibility for all activities that occur under your account

- Notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

You must be at least 13 years of age (or 16 in the European Economic Area) to create an account. By creating an account, you represent and warrant that you meet the age requirement and have the legal capacity to enter into these Terms.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause or notice, for any reason including, but not limited to:

- Violation of these Terms

- Fraudulent, abusive, or illegal activity

- Prolonged inactivity

- Request by law enforcement or government agencies

You may delete your account at any time through the App settings.

4. User-Generated Content

4.1 Content You Submit

You retain ownership of any content you submit to the App, including reviews, ratings, restaurant submissions, photos, and comments ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to:

- Use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media

- Use your name, username, and profile picture in connection with such User Content

- Use such User Content for advertising and promotional purposes

Note on Account Deletion: If you delete your account, we will stop using your User Content for new purposes. However, User Content that has already been published or distributed may remain accessible to other users, and we may retain copies as necessary for legal compliance, dispute resolution, or legitimate business purposes (such as maintaining the integrity of restaurant listings).

4.2 Content Standards

You agree not to submit User Content that:

- Is false, misleading, or deceptive

- Violates any law, regulation, or third-party right

- Is defamatory, libelous, obscene, pornographic, or offensive

- Contains hate speech, discrimination, or harassment

- Infringes intellectual property rights

- Contains spam, unsolicited advertising, or promotional materials

- Contains viruses, malware, or other harmful code

- Impersonates any person or entity

4.3 Content Moderation

We reserve the right, but are not obligated, to:

- Review, edit, or remove any User Content at any time

- Refuse to publish or remove any restaurant submission

- Suspend or terminate accounts that violate these Terms

- Take legal action against users who violate these Terms

We do not guarantee that we will monitor or remove objectionable User Content, and you use the App at your own risk.

4.4 Restaurant Submissions

When you submit a restaurant to the App:

- You represent that you have the right to submit such information

- You acknowledge that submissions are subject to review and approval

- We reserve the right to reject, modify, or remove any submission

- Approved submissions become part of the App's database and may be used by all users

- You may not submit false or misleading information about restaurants

5. Intellectual Property Rights

5.1 Our Rights

The App, including its design, text, graphics, logos, icons, images, software, and other content, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

- Copy, modify, or create derivative works of the App

- Reverse engineer, decompile, or disassemble the App

- Remove any copyright, trademark, or other proprietary notices

- Use our trademarks, logos, or brand names without our prior written consent

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

- Access and use the App for personal, non-commercial purposes

- Download and install the App on your personal devices

This license does not include any right to resell or commercially use the App or its content.

6. Prohibited Uses

You agree not to:

- Use the App for any illegal purpose or in violation of any laws

- Interfere with or disrupt the App or servers connected to the App

- Attempt to gain unauthorized access to the App or related systems

- Use automated systems (bots, scrapers) to access the App without permission

- Transmit any viruses, malware, or harmful code

- Collect or harvest information about other users

- Use the App to compete with us or build a similar service

- Impersonate any person or entity or misrepresent your affiliation

- Harass, abuse, or harm other users

7. Location Services

The App uses location services to provide location-based features. By using the App, you consent to the collection and use of your location data as described in our Privacy Policy. You can disable location services through your device settings, but this may limit certain App features.

8. Third-Party Services

The App may integrate with third-party services, including:

- Google Maps and Google Places API for mapping and location services

- Supabase for authentication and data storage

- Sentry for error tracking and monitoring

Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimers and Limitations of Liability

9.1 No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO:

- WARRANTIES OF MERCHANTABILITY

- FITNESS FOR A PARTICULAR PURPOSE

- NON-INFRINGEMENT

- ACCURACY, RELIABILITY, OR COMPLETENESS OF INFORMATION

We do not warrant that:

- The App will be uninterrupted, secure, or error-free

- Defects will be corrected

- The App is free of viruses or other harmful components

- Restaurant information is accurate, complete, or current

9.2 User-Generated Content Disclaimer

We do not endorse, verify, or guarantee the accuracy, completeness, or quality of User Content, including restaurant reviews, ratings, or submissions. User Content reflects the opinions of individual users and not our views.

9.3 Restaurant Information

We do not guarantee the accuracy of restaurant information, including:

- Halal certification status

- Operating hours

- Menu availability

- Prices or services offered

Users should verify information directly with restaurants before visiting.

9.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

- LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES

- DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP

- DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR USE OF YOUR ACCOUNT

- DAMAGES RESULTING FROM THIRD-PARTY SERVICES OR CONTENT

SINCE THE APP IS PROVIDED FREE OF CHARGE, OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE EQUIVALENT IN YOUR LOCAL CURRENCY, EXCEPT WHERE SUCH LIMITATION IS PROHIBITED BY LAW.

9.5 Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

- Your use of the App

- Your violation of these Terms

- Your violation of any third-party right

- Your User Content

- Your violation of any law or regulation

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.

11.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Stockholm, Sweden.

EU Consumer Protection: If you are a consumer residing in the European Economic Area, you may also bring proceedings in the courts of your country of residence. This does not affect your rights as a consumer under the mandatory laws of your country of residence.

11.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

11.4 Arbitration

If you are located outside the European Economic Area, you agree that any dispute shall be resolved through binding arbitration in accordance with the rules of the Arbitration Institute of the Stockholm Chamber of Commerce, except where prohibited by law.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

- Posting the updated Terms in the App

- Updating the "Last Updated" date

- Sending you an email notification (if you have provided an email address)

Your continued use of the App after such changes constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the App and delete your account.

13. Termination

13.1 Termination by You

You may stop using the App at any time by deleting your account through the App settings.

13.2 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including:

- Violation of these Terms

- Fraudulent or illegal activity

- Extended periods of inactivity

- Request by law enforcement

13.3 Effect of Termination

Upon termination:

- Your right to use the App will immediately cease

- We may delete your account and User Content

- Provisions that by their nature should survive termination will remain in effect

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet failures.

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
